Morris Nichols serves as Delaware counsel for Successful Patent Litigation Team in Dow Chemical's $61.7 Million Patent Infringement Verdict

Wilmington, DE - July 8, 2010 - Morris Nichols’ Intellectual Property Litigation Group partner Rodger D. Smith II served as Delaware counsel on the patent litigation team that successfully represented The Dow Chemical Co. in its recent patent infringement trial against rival Nova Chemicals.

After a two week trial, the District of Delaware jury found that Nova infringed two Dow patents for polyethylene blends that provide a unique combination of good impact strength and good tear resistance, which are used in high performance film applications such as super-strong shipping sacks.  The jury awarded Dow nearly $58 million in lost profits and over $4.3 million in royalties.
