John DiTomo Comments on Dole Chancery Opinion for Law360

On Friday, Feb. 27, 2015, Vice Chancellor Laster issued an opinion that said an expert witness must have “a body and brain” to testify. The ruling occurred after a party attempted to designate a corporate entity as a witness. Morris Nichols partner John P. DiTomo discussed the ruling with Law360. “People are just going to have to be a little bit more precise in identifying a person who is going to be testifying,” he said. “That individual needs to be directing and supervising the work, and needs to testify to those matters.” If not, it opens the possibility of a witness being rejected. “That line of attack has always been there, and it will still be there after this decision,” John concluded.
