The American Bar Association’s Section of Litigation Bankruptcy and Insolvency Litigation Committee presents a roundtable discussion on trends in bankruptcy litigation with the Hon. Robert E. Gerber and the Hon. Rosemary Gambardella on November 13, 2018 from 12:30-1:30 p.m. ET.

Morris Nichols partner Curtis Miller will speak as a co-panelist. The roundtable will cover cutting edge bankruptcy litigation developments, including:

  • Crystallex Int'l Corp. v. Bolivarian Republic of Venez., which analyzed alter ego theories of liability applicable to sovereign and non-sovereign parties;
  • The potential Circuit split between the Second and Third Circuits (and others) applying non-consensual third party releases, including the Delaware District Court’s affirmance of the constitutionality of third party releases in In re Millennium Lab Holdings; and
  • Recent decisions addressing standards to determine unfair discrimination of dissenting classes in a plan, equitable mootness, and limitations on the duties of care and loyalty for limited liability companies.
