Todd Flubacher Quoted by Financial Times on the Benefits of Directed Trusts

Morris Nichols partner Todd Flubacher recently spoke with The Financial Times in an article titled, “Why Directed Trusts Can Be Effective in Asset Management.”  In his Delaware trust law practice, Todd finds the “overwhelming majority” of his cases involve directed trusts.

He said this model provides certain advantages in jurisdictions like Delaware which have a strong directed trust statute.  He noted that often with Delaware directed trusts, “trustees do not monitor or second-guess the investment adviser in charge of special assets,” and so lower fees contribute to the popularity of directed trusts.
