Eric Schwartz Moderates at ABI’s 2009 Complex Financial Restructuring Program Case Study of Corporate Reorganization Process

Wilmington, DE – September 21, 2009 – Morris Nichols business reorganization and restructuring partner Eric Schwartz served as a program moderator at ABI’s 2009 Complex Financial Restructuring Program (CFRP) case study held concurrently with ABI’s 17th Annual Southwest Bankruptcy Conference at the Hyatt Regency Lake Tahoe Resort, Incline Village, Nevada, on September 10-11, 2009.  This year’s Conference attracted 325 attendees; 50 participated in the CFRP.

Eric’s panel Management and the Company’s View discussed a fictional company’s impending liquidity crisis and possible solutions, including a potential Chapter 11 filing versus alternatives.  The Panel discussed cost/benefits of chapter 11, including related DIP financing, executory contract and lease rejections, formulation of a plan of reorganization, as well as the possible rejection of the collective bargaining agreement.
