September 11, 2009, Incline Village, NV
Wilmington, DE (August 17, 2009) – Business Reorganization and Restructuring Group partner and practice group coordinator Robert Dehney will serve as a featured moderator at the ABI 2009 Complex Financial Restructuring Program (CFRP) case study to be held concurrently with ABI’s 17th Annual Southwest Bankruptcy Conference at the Hyatt Regency Lake Tahoe Resort, Incline Village, Nevada, on September 10-11, 2009.
CFRP registrants will receive a case study of a fictional distressed company and its subsidiaries (a vertically integrated producer and distributor of wallboard products serving residential and commercial applications throughout the US) in advance and leaders in the industry will play the role of the major parties-in-interest who will dramatize their various perspectives as they work through whether the company, which has defaulted on its senior loan facility, should file for chapter 11 and what steps should be taken in restructuring the company.
Rob will moderate the day-long program’s morning panel Management and the Company’s View involving a discussion of the fictional company’s impending liquidity crisis and possible solutions, including the sale of a subsidiary, potential IRS refunds and a new product launch. Rob will probe the company’s CEO, investment banker and counsel with respect to the cost/benefits of chapter 11, including preference and fraudulent conveyance analyses, lease rejections, rejection of collective bargaining agreements and alternatives to chapter 11.
